Aaniie Platform Services Acceptable Use Policy (AUP)

Use of the Services is subject to this Acceptable Use Policy. Capitalized terms have the meaning stated in the applicable agreement between the CUSTOMER and Aaniie.

1. Purpose

This Acceptable Use Policy (“Policy”) outlines the rules and restrictions governing access to and use of the Aaniie platforms, applications, APIs, websites, and all related software services (collectively, the “Services”). The purpose of this Policy is to ensure legal, secure, ethical, compliant, and reliable use of the Service for all customers and users – especially when handling protected and sensitive data.

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO COMPLY WITH THIS POLICY. CUSTOMERS ARE RESPONSIBLE FOR ENSURING THAT THEIR EMPLOYEES, CONTRACTORS, PARTNERS, AND END-USERS FOLLOW THIS POLICY.

2. Prohibited Activities.

Customer and Users agree not to directly or indirectly use the Services, or to allow any third parties using the Services to:

2.1 Security Violations.

2.1.1 Attempt to access accounts, systems, data, or networks without authorization.
2.1.2 Bypass or disable security features, encryption, authentication, or access controls.
2.1.3 Introduce malware, ransomware, viruses, worms, spyware, corrupted files, hoaxes, trojans, or malicious code or other items of a destructive or deceptive nature.
2.1.4 Probe, scan, or test the vulnerability of the Service, conduct penetration testing, load testing, ethical hacking, monitoring of the Services, or their infrastructure without prior written approval.
2.1.5 Access the services with the use of any digital program, script, bots, crawling tools, scrapers, or automated technology or other software that is not explicitly approved in writing by Aaniie.
2.1.6 Interfere with or disrupt system performance, including denial-of-service (DoS) attacks or excessive load generation.

2.2 Misuse of Accounts or Access.

2.2.1 Share login credentials, impersonate another individual or entity, or misrepresent identity.
2.2.2 Create accounts using false information or automated tools without authorization.
2.2.3 Attempt to access data, modules, or functionality not expressly permitted.
2.2.4 Attempt to gain unauthorized access to, disrupt, or impair the use of the Services, or the equipment used to provide the Services, by customers, third parties, or other authorized users.
2.2.5 Attempt to disable, interfere with or circumvent any aspect of the Services, Software, or the equipment used to provide the Services.
2.2.6 Attempt to generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisements, or other solicitations (ìspamî).
2.2.7 Use the Services, or any interfaces provided with the Services, to access any other Aaniie product or service in a manner that violates the terms of service of such other Aaniie product or service.
2.2.8 Store sensitive data outside of the Services in a manner that violates HIPAA, GDPR, or other applicable regulations.

2.3 Unauthorized Data Use.

2.3.1 Allow services to be accessed for the purposes of monitoring their ability, performance, or functionality, or for any other benchmarking or competitive purposes.
2.3.2 Provide access to Aaniieís direct competitors or other third parties, which are prohibited from accessing the Services.
2.3.3 Permit access to the Services by any type of virtual assistant or third-party call centers without written consent from Aaniie.
2.3.4 Access, store, transmit, export, scrape, or collect data in violation of law, privacy policies, or the customerís contractual rights.
2.3.5 Use the Service to violate intellectual property rights, including copying, reverse-engineering, decompiling, or modifying the Service or its content.
2.3.6 Remove proprietary notices, branding, or disclaimers.

2.4 Fraud or Harmful Conduct.

2.4.1 Violate, or encourage the violation of, the legal rights of others.
2.4.2 Violate any applicable federal, state, or international law or regulation ñ including HIPAA, OSHA, GDPR, CMS rules, or data protection laws.
2.4.3 Engage in, promote, or encourage illegal activity, including child sexual exploitation, child abuse, elder abuse, or terrorism or violence that can cause death, serious harm, or injury to individuals or groups of individuals.
2.4.4 Use the Services for any unlawful, invasive, infringing, defamatory or fraudulent purpose, including Non-consensual Explicit Imagery (NCEI), violating intellectual property rights of others, phishing, or creating a pyramid scheme.
2.4.5 Engage in harassment, threats, hate speech, discriminatory behavior, or abusive conduct.
2.4.6 Publish or distribute offensive, deceptive, defamatory, or fraudulent material.
2.4.7 Falsify records, billing claims, payroll, scheduling, time entries, or documentation.
2.4.8 Impersonate another person or organization, or misrepresent identity or credentials.
2.4.9 Conduct or support illegal activity of any kind.

2.5 Platform Interference & Automation.

2.5.1 Use bots, scripts, crawling tools, scrapers, or automated technology in a way that bypasses rate limits, API rules, or standard system use.
2.5.2 Overload infrastructure, perform denial-of-service attacks, or take any action in Aaniie’s judgment that threatens the security, integrity, degrades system performance, or availability of the Services.
2.5.3 Reverse-engineer, decompile, copy, modify, or create derivative works of the Services.
2.5.4 Upload files or content that exceed system limits or degrade service functionality.

3. Customer Responsibilities.

Customers agree to:
3.1 Maintain accurate business and account information.
3.2 Ensure authorized and trained users are the only individuals accessing the platform.
3.3 Ensure users are authorized and trained to handle PHI/ Protected Health Information (PHI), Personally Identifiable Information (PII), and other sensitive data.
3.4 Implement reasonable safeguards for devices and networks used to access the Service.
3.5 Notify the provider promptly of any suspected security breach, misuse, or unauthorized access.

4. Third-Party Applications & Integrations.

4.1 Users may not:

4.1.1 Connect third-party software, integrations, or data-ingestion tools that violate security controls or contractual terms.
4.1.2 Use APIs in a manner inconsistent with published documentation, rate limits, or security requirements.

4.2 And must:

4.2.1 Assure that approved third-party integrations follow the Service’s technical and legal guidelines.

5. Clinical Judgment.

The CUSTOMER acknowledges and agrees that nothing provided by Aaniie is intended to replace clinical judgment. Information provided by Aaniie should never be utilized on its own to make any treatment decisions. CUSTOMER’s clinical expertise should be utilized, and it is critical that any patient’s or client’s conditions are monitored by CUSTOMER and confirmed before any treatment. Improper use of the Service without adequate clinical review and/or lack of clinical expertise could lead to an adverse event. Only trained and authorized individuals should utilize the Services.

5.1 Responsibility.

The CUSTOMER has complete responsibility for setting proper procedures and for any clinical decisions. Any system-provided medication interaction data provided through the Services and integrations to the National Library of Medicine (NLM) is not intended to provide specific medical advice, but rather to provide Users with information to better understand health and medications. CUSTOMERs are fully responsible for consulting with a qualified physician or medical expert for all advice about medications, setting care plans, procedures, and making clinical decisions.

6. Monitoring & Enforcement.

Aaniie reserves the right to:
6.1 Monitor usage for security, compliance, performance, and support purposes.
6.2 Investigate actual or suspected violations.
6.3 Suspend, restrict, or terminate access that violates this Policy or risks platform integrity.
6.4 Report illegal activity to law enforcement or regulators if required.

7. Violations.

Violations of this Policy may result in:
7.1 Temporary or permanent account suspension
7.2 Loss of data export/access rights
7.3 Termination of the customer agreement
7.4 Civil or criminal liability, if applicable

CUSTOMERS MAY BE HELD RESPONSIBLE FOR ANY DAMAGES RESULTING FROM MISUSE OF THE SERVICE.

8. Changes to this Policy.

Aaniie may update this Policy from time to time to reflect legal, technical, or operational changes. Continued use of the platform constitutes acceptance of the current version.

9. Acceptance.

By using the Service, Users acknowledge and agree to comply with this Acceptable Use Policy.
